NEWMOM.ME ACADEMY TERMS AND CONDITIONS
1. Acceptance of Terms
By enrolling in the Newmom.me Training Programs (the "Program"), you ("Participant") agree to abide by these terms and conditions ("Terms"). If you do not agree with any part of these Terms, you should not proceed with the enrollment process.
2. Program Enrollment and Eligibility
2.1 Eligibility: Participants must be at least 18 years old to enroll in the Program.
2.2 Enrollment Process: Enrollment in the Program is subject to payment of the applicable fees.
3. Program Fees and Payment
3.1 Fees: The Program fee is published on the website.
3.2 Payment: You can either pay in full or opt for a payment plan. If using a payment plan, you agree to complete all the payments, failing which you will be charged 10% late fee.
3.3 Refunds: Please be advised that all sales are final AND No refunds will be issued.
3.4 Non payments: By enrolling in a course with Newmom.me Academy, students agree to fulfill their financial obligations as outlined in the payment agreement. In the event of non-payment or failure to adhere to the agreed-upon payment schedule, Newmom.me Academy reserves the right to take appropriate legal action to recover the outstanding balance. This may include, but is not limited to, engaging a collections agency, filing a claim in small claims court, or pursuing other legal remedies available under applicable law. The student may also be responsible for any additional costs incurred during the collection process, including legal fees and court costs. Continued access to the course material may be suspended or terminated until full payment is received.
4. Course Materials and Access
4.1 Materials: All course materials are provided digitally and are included in the Program fee.
4.2 Access: Participants will create credentials to access the online learning platform. Sharing login information with others is strictly prohibited.
5. Participant Conduct
5.1 Code of Conduct: Participants are expected to maintain professional and respectful behavior throughout the Program.
5.2 Academic Integrity: Participants must complete all assignments, quizzes, and exams independently. Plagiarism and cheating are grounds for immediate dismissal from the Program without a refund.
6. Program Completion and Certification
6.1 Requirements: To receive certification, Participants must complete all required coursework, pass all assessments, and participate in any mandatory practical training sessions.
6.2 Certification: Upon successful completion of the Program, Participants will receive a certificate of completion.
6.3 This program does not provide clinical training, so students must not offer medical advice. All care and medical questions should be referred to appropriate healthcare providers.
7. Intellectual Property
7.1 Ownership: All course materials, including but not limited to written content, videos, and digital resources, are the property of Newmom.me and are protected by copyright laws.
7.2 Use: Participants are granted a non-exclusive, non-transferable license to use the course materials for personal, educational purposes only. Reproduction, distribution, or commercial use of the materials is prohibited.
8. Privacy and Data Protection
8.1 Data Collection: The Program will collect and store personal information provided by Participants during the enrollment process. This information will be used for administrative purposes and to communicate with Participants.
8.2 Data Protection: Personal information will be handled in accordance with Newmom.me's Privacy Policy. Participants' data will not be shared with third parties without consent, except as required by law.
9. Limitation of Liability
9.1 Disclaimer: The Program is provided "as is" without any warranties, express or implied. Newmom.me does not guarantee the accuracy, completeness, or usefulness of any course content.
9.2 Liability: Newmom.me and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from (a) the use or inability to use the Program; (b) any changes made to the Program or any temporary or permanent cessation of the Program or any part thereof; (c) unauthorized access to or alteration of your transmissions or data; (d) the cost of procurement of substitute goods and services; (e) delivering of services after taking the program or (f) any other matter relating to the Program.
10. Amendments
10.1 Modifications: Newmom.me reserves the right to modify these Terms at any time. Participants will be notified of any changes via email or through the Program’s online platform.
11. Governing Law
11.1 Jurisdiction: These Terms are governed by and construed in accordance with the laws of California, USA. Any disputes arising out of or related to these Terms shall be resolved in the courts of California, USA.
